Bousquet and Roman Secure Appellate Court Decision on Contract Dispute over Right of First Refusal
After a landowner in Iron County (Missouri) refused to sell only a portion of land subject to a Right of First Refusal (ROFR), the ROFR holders filed suit. Both the landowner and the ROFR holders filed cross motions for summary judgment. The trial court granted summary judgment in favor of the holders. The case was then referred to HeplerBroom attorneys Patrick Bousquet and Emily Roman to file an appeal on behalf of the landowners. Based on appellate briefs written by Bousquet and Roman, the Missouri Southern District Court of Appeals reversed the trial court’s granting of summary judgment. Instead, it instructed the trial court to grant the landowner’s motion for summary judgment and enter an award of reasonable attorney fees to the landowner.
