Attorneys in HeplerBroom’s Springfield office, partners Thomas Wilson and Michael Murphy and associate Jessica Galanos, prevailed in an appeal in the Appellate Court of Illinois, Fourth District.  In Peters v. Riggs, 2015 IL App (4th) 140043, the appellate court held that claims against the firm’s client, a major utility company, were properly dismissed with prejudice by the trial court because the utility company owes no duty to provide illumination on a city street to a pedestrian walking outside of a crosswalk and crossing a street mid-block.  The court further held that contribution claims against the utility company were also properly dismissed with prejudice based on the lack of duty.
