Missouri Court of Appeals Hands Down Reminder that Not All Remedial Measures are Inadmissible

In Watson v. City of St. Peters, the Missouri Court of Appeals reversed a defense verdict after finding that the trial court improperly excluded evidence showing the City had prior notice of a dangerous sidewalk condition caused by stormwater sump inlets. Because the City had implemented a corrective plan following a similar 2012 accident—before the plaintiff’s 2014 injury—the appellate court held the evidence was admissible to establish notice and should have been presented to the jury.
