At the conclusion of a St. Louis City personal injury trial, the court awarded plaintiff just $750—substantially less than the $900,000 pre-suit demand made against Adam McGonigle’s client.

Plaintiff alleged he sustained a debilitating and permanent knee injury after a bus door closed on his leg. HeplerBroom’s transportation company client admitted liability but vigorously contested causation and damages. Plaintiff’s claimed damages included two surgeries, years of physical therapy, and nearly a decade of lost wages.

However, during discovery, the defense uncovered medical records revealing multiple prior undisclosed knee injuries and a history of claimed disability. This discovery contradicted plaintiff’s denial of any pre-existing conditions, evidence that proved critical in significantly limiting the damages awarded.

McGonigle, a partner in the firm’s St. Louis office, was assisted at trial by associate attorney Gabrielle Deimeke.
