Tom Magee and Kate Aplington obtained summary judgment in favor of a hockey rink operator in St. Charles County. The plaintiff sustained serious damage to his eye due to a high sticking incident with another player. The Plaintiff alleged the defendant was negligent in failing to have referees keep control of the game and prevent the high sticking incident. The court entered judgment in favor of our client based on our argument that plaintiff assumed the risks of the injury due to the nature of the sport and that there had been no prior problems with the hockey player who caused the injury.
