A Jefferson County, Missouri, jury unanimously found in favor of Meg Fowler and Peter Houser’s client in a case of drainage issues on a property.

Plaintiff alleged that the client had cleared more trees during construction than originally proposed and should have built a detention basin, creating a dangerous condition. Fowler and Houser were able to show that the building on the property had been built in accordance with plans approved by the county. They also pointed out that the flooding issues that occurred happened two years after construction was completed, were consequences of a 100- to 200-year storm event, and resulted in other properties within a mile or two of the site calling 9-1-1 for water rescue, including properties uphill from both the plaintiff’s and client’s properties.
