Kowert And Deterding Prevail Before Illinois Fifth District Court Of Appeals

David Kowert and David Deterding prevailed before the Illinois Fifth District Court of Appeals in the matter of Fillback v. Illinois Workers’ Compensation Commission and Keller Construction. Mr. Kowert and Mr. Deterding represented Keller Construction, and argued to the Court that the Illinois Workers’ Compensation Commission’s denial of benefits was not against the manifest weight of the evidence and should stand. The Court of Appeals affirmed the denial, citing contradictory and inconsistent medical evidence and testimony. The case had been appealed from the Madison County Circuit Court, which also upheld the Commission’s denial.
