Kathleen Hamilton has secured a summary judgment in a St. Francois County (Missouri) work-related injury case involving two co-workers. Although the plaintiff sought damages from his co-worker (HeplerBroom’s client), plaintiff did not allege–and had no evidence–that the co-worker’s alleged conduct was done with the “specific purpose to cause or increase the risk of injury” to him. In fact, plaintiff testified that he thought his co-worker was trying to “help” him, so much so that he invited the co-worker to a barbeque at his house afterwards. Hamilton successfully noted that under those circumstances, the co-worker was immune from suit pursuant to Section 287.120 of the Workers’ Compensation Act and was entitled to summary judgment.
Hamilton, a partner in the firm’s St. Louis office, focuses her practice on the defense of personal injury litigation and insurance matters. She has also successfully handled numerous appellate cases. In 2021 she was appointed by the Missouri Supreme Court to the Joint Commission on Women in the Profession.
