Stephanie Weiner and Sarah Jansen secured a dismissal with prejudice in the Northern District of Illinois on behalf of a municipality.
The claim involved allegations of false arrest following a 2018 arrest. However, plaintiff did not file his lawsuit until August 2023. The Court found that the two-year statute of limitations period started upon plaintiff’s arrest, and that contrary to plaintiff’s argument, there was no basis to pause, delay, or extend the running of that time period. Therefore, the Court ruled that plaintiff’s suit was terminated and could not be refiled.
Weiner, a partner in the firm’s Chicago office, defends personal injury cases, primarily in municipal and §1983 claims.
