Larry Hepler, Beth Bauer, David Bays, Gregg Kinney and Beth Kellett, HeplerBroom attorneys, obtained a reversal of class certification in a case filed by Roxana, IL residents, who allege that groundwater contamination caused by the current and former owners of the oil refinery located in Roxana diminished their property values. The U.S. Court of Appeals for the Seventh Circuit reversed the class certification order, stating: “The plaintiffs in this case have presented no theory, let alone credible evidence, of a connection between the leaks [and] property values, or between specific defendants and the leaks and property values, that would justify a class action . . . .” For more information on Parko v.
