Nielsen and Caldwell Successfully Defend Cook County Hospital Against Negligence Claim

Just prior to the conclusion of a Cook County jury trial, Mary Nielsen and Chelsea Caldwell received a directed verdict on behalf of a Cook County area hospital.

Plaintiff had claimed that an independently contracted ophthalmologist working in the hospital’s emergency department failed to recommend the appropriate medication be administered to treat his central retinal artery occlusion. Nielsen and Caldwell successfully argued that the Plaintiff had failed to prove the defendant ophthalmologist was the apparent agent of the hospital.

Nielsen, a partner, and Caldwell, an associate, are with the firm’s DuPage County office. Nielsen focuses her practice on the defense of healthcare providers, including hospitals, physicians, nurses, and nurse anesthetists as well as physical, occupational, and speech therapists. Caldwell focuses her practice on the defense of medical and dental malpractice, nursing home, and professional liability matters.
