Banasek and Boeckman Secure Summary Judgment on Hospital COVID Negligence Suit
Tammy Banasek and LaDonna Boeckman, partners with the Chicago office’s professional liability and medical malpractice groups, secured a partial summary judgment for a hospital utilizing Illinois Governor Pritzker’s Executive Order 2020-19, which provided immunity to health care providers, health care institutions, and volunteers who rendered assistance to the State’s response to the COVID-19 pandemic.
Plaintiff had developed a sacral wound during a hospitalization in early 2020 and alleged the hospital was negligent and alleged willful and wanton conduct. The judge found, based upon evidence provided in the Motion, that the hospital was rendering assistance to the State pursuant to the Governor’s Executive Order and the Illinois Emergency Management Agency Act and entered summary judgment on all counts of the Amended Complaint related to allegations of negligence.
