Mueller and Deterding Obtain Summary Judgment in St Louis County

Amanda M. Mueller and David J. Deterding obtained summary judgment in St. Louis County. Plaintiff Jane Doe had alleged that she was sexually assaulted by a masked man on University of Missouri-St. Louis' campus. She brought suit against UMSL and two administrators under the negligence theories of failure to warn, failure to maintain the property, failure to properly use information, and permitting an increased risk of harm over and above the ordinary risk of crime. Summary judgment was obtained for the defendants after arguments that: (1) the defendants were protected from suit under the doctrines of sovereign and official immunity; and (2) the defendants had no general duty to protect another person from a deliberate, criminal attack by a third person.
